AN ACT
1 Extending the deadline for filing for a permit for disposal of
2 municipal wastes.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Permit application filing deadlines.
6 Notwithstanding any other law or regulation to the contrary,
7 a county or municipality which as of April 9, 1990, has a permit
8 issued prior to April 9, 1988, for a currently existing
9 municipal waste landfill LINED WITH MATERIALS THAT ARE NO MORE <--
10 PERMEABLE THAN 1 X 10 (TO THE MINUS 5 EXPONENT) CM/SEC., and by
11 April 8 9, 1990, has an administratively complete application <--
12 covering the construction of new facilities under review by the
13 Department of Environmental Resources, can accept municipal
14 waste for disposal in the existing landfill until the new site
15 is permitted and complete, or September 30, 1991, whichever
16 occurs first, UNLESS THE COUNTY OR MUNICIPALITY RECEIVES A FINAL <--
17 DENIAL OF ITS PERMIT. The new site shall comply with 25 Pa. Code
1 Chs. 271 (relating to municipal waste management - general
2 provisions) and 273 (relating to municipal waste landfills).
3 Section 2. Effective date.
4 This act shall take effect immediately.
