           PECORA, FUMO, SALVATORE, HELFRICK, GREENWOOD AND SHAFFER,
           APRIL 4, 1990

                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, further providing certain
     3     immunity to individuals and organizations.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 42 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 2303.  Immunity of certain personnel.
     9     Any probation officer and any public service or charitable
    10  agency or organization or political subdivision, or any employee
    11  thereof, supervising or administering any program authorized by
    12  law shall be immune from any civil action for damages brought by
    13  or on behalf of any person involved in the program. Nothing in
    14  this section shall be construed to limit or otherwise affect or
    15  preclude liability resulting from gross negligence or
    16  intentional misconduct or reckless misconduct.
    17     Section 2.  This act shall take effect in 60 days.
