SENATE BILL

                                     AN ACT

     1  Amending the act of June 29, 1996 (P.L.434, No.67), entitled, as
     2     amended, "An act to enhance job creation and economic
     3     development by providing for an annual financing strategy,
     4     for opportunity grants, for job creation tax credits, for
     5     small business assistance, for the Small Business Advocacy
     6     Council, for a family savings program, for industrial
     7     development assistance, for community development bank grants
     8     and loans and for tax-exempt bond allocation; conferring
     9     powers and duties on various administrative agencies and
    10     authorities; further providing for various funds; and making
    11     repeals," repealing transitional loan provisions.

    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14     Section 1.  Section 5104 of the act of June 29, 1996
    15  (P.L.434, No.67), known as the Job Enhancement Act, is amended
    16  to read:
    17  [Section 5104.  Transitional provisions.
    18     (a)  Capital Loan Fund applications.--Applications for
    19  assistance under the act of July 2, 1984 (P.L.545, No.109),
    20  known as the Capital Loan Fund Act, which have been approved by
    21  the department prior to the effective date of this chapter shall
    22  be processed in accordance with the provisions of the Capital

     1  Loan Fund Act. Applications for assistance which have been
     2  received by the department but which have not been approved
     3  prior to the effective date of this chapter shall be evaluated
     4  and processed in accordance with the provisions of this chapter.
     5     (b)  Air Quality Improvement Fund, Storage Tank Loan Fund and
     6  Recycling Incentive Development Account applications.--
     7  Applications for assistance made under section 7.13 of the act
     8  of January 8, 1960 (1959 P.L.2119, No.787), known as the Air
     9  Pollution Control Act, section 709 of the act of July 6, 1989
    10  (P.L.169, No.32), known as the Storage Tank and Spill Prevention
    11  Act, and made to the Recycling Incentive Development Account,
    12  which have been approved by the Secretary of Environmental
    13  Protection or the Department of Environmental Protection prior
    14  to the effective date of this chapter shall be processed in
    15  accordance with these respective statutory provisions.
    16  Applications for assistance which have been received by the
    17  Department of Environmental Protection but which have not been
    18  approved prior to the effective date of this chapter shall be
    19  evaluated and processed in accordance with Chapter 13.]
    20     Section 2.  This act shall take effect immediately.
