AN ACT 1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania 2 Consolidated Statutes, providing for home invasion robbery. 3 The General Assembly of the Commonwealth of Pennsylvania 4 hereby enacts as follows: 5 Section 1. Title 18 of the Pennsylvania Consolidated 6 Statutes is amended by adding a section to read: 7 § 3504. Home invasion robbery. 8 (a) Offense defined.--A person commits an offense under this 9 section if he enters a building or occupied structure, or 10 separately secured or occupied portion thereof, with intent to: 11 (1) inflict serious bodily injury upon another; 12 (2) threaten another with or intentionally put another 13 in fear of immediate serious bodily injury; 14 (3) inflict bodily injury upon another or threaten 15 another with or intentionally put another in fear of 16 immediate bodily injury; or 17 (4) physically take or remove property from the person
1 of another by force, however slight. 2 (b) Defense.--It is a defense to prosecution under this 3 section that the building or structure was abandoned or the 4 actor is licensed or privileged to enter. 5 (c) Grading.-- 6 (1) Except as provided in paragraph (2), an offense 7 under this section is a felony of the second degree. 8 (2) If no individual is present at the time of entry, an 9 offense under this section is a felony of the third degree. 10 Section 2.
