AN ACT 1 Amending the act of October 21, 1988 (P.L.962, No.114), entitled 2 "A supplement to the act of July 3, 1987 (P.L.190, No.26), 3 entitled 'An act providing for the capital budget for the 4 fiscal year 1987-1988,' itemizing public highway projects to 5 be constructed by the Department of Transportation, together 6 with the estimated financial costs; authorizing the incurring 7 of debt without the approval of the electors for the purpose 8 of financing the projects to be constructed by the Department 9 of Transportation; stating the estimated useful life of the 10 projects; and making appropriations," amending a project in 11 Armstrong County; and increasing the debt authorization and 12 appropriation. 13 The General Assembly of the Commonwealth of Pennsylvania 14 hereby enacts as follows: 15 Section 1. Section 2 of the act of October 21, 1988 16 (P.L.962, No.114), known as the Highway Supplement to the 17 Capital Budget Act of 1987-1988, amended March 13, 1990 (P.L.75, 18 No.16), is amended to read: 19 Section 2. Authorization. 20 The total authorization for the capital projects in the 21 category of highway projects itemized in section 3 and to be 22 constructed by the Department of Transportation, its successors
1 or assigns, and to be financed by the incurring of debt, or from 2 current revenues of the Motor License Fund, shall be 3 [$2,289,667,000] $2,296,052,000. 4 Section 2. Section 3(2)(iii) of the act is amended to read: 5 Section 3. 1 (Design and Contingencies - $220,000) 2 * * * 3 Section 3. Sections 5 and 8 of the act, amended March 13, 4 1990 (P.L.75, No.16), are amended to read: 5 Section 5. Debt authorization. 6 The Governor, Auditor General and State Treasurer are hereby 7 authorized and directed to borrow, from time to time, in 8 addition to any authorization heretofore or hereafter enacted, 9 on the credit of the Commonwealth, subject to the limitations 10 provided in the current capital budget, money not exceeding in 11 the aggregate the sum of [$2,289,667,000] $2,296,052,000 as may 12 be found necessary to carry out the acquisition and construction 13 of the highway projects, specifically itemized in section 3 of 14 this capital budget. 15 Section 8. Appropriation. 16 The net proceeds of the sale of the obligations herein 17 authorized are hereby appropriated from the Capital Facilities 18 Fund to the Pennsylvania Department of Transportation in the 19 maximum amount of [$2,289,667,000] $2,296,052,000 to be used by 20 it exclusively to defray the financial costs of the projects 21 specifically itemized in section 3 of this capital budget. After 22 reserving or paying the expenses of the sale of the obligation, 23 the State Treasurer shall pay out to the Pennsylvania Department 24 of Transportation the moneys as required and certified by it to 25 be legally due and payable. 26 Section 4.
