           SHUMAKER, GREENWOOD, BELL, JUBELIRER, MADIGAN, HELFRICK AND

                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," authorizing school districts to
     6     develop and implement integrated collaborative support
     7     service programs for certain students.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    11  as the Public School Code of 1949, is amended by adding a
    12  section to read:
    13     Section 1512.1.  Education Support Systems.--(a)  Any school
    14  district may provide an integrated collaborative student support
    15  system. School districts may where they deem appropriate develop
    16  an integrated collaborative support service program to assist
    17  students enrolled in basic education programs who have been
    18  identified by their instructor as being at risk of not achieving
    19  their potential either academically or developmentally.


     1     (b)  To receive funds under this section, a school district
     2  shall develop and submit to the Department of Education a
     3  description of the programs and services it has in place to
     4  assist students who are at risk of not achieving in school
     5  according to their needs and abilities. Such services may
     6  include, but need not be limited to, remediation programs,
     7  health services, counseling services, assessment and evaluation
     8  services or home and school visitor or social work services. The
     9  purpose of the description is to set forth student support
    10  programs and services in an integrated way so that they most
    11  effectively and efficiently meet the needs of students. The
    12  program description shall be prepared for each school building
    13  in the district by a team of professional employees chaired by
    14  the principal or the principal's designee. Each school building
    15  is encouraged to develop systems that provide opportunities for
    16  school professionals to meet on a regular basis with the
    17  principal or the principal's designee to share information which
    18  will assist teachers in addressing the specific learning
    19  behavioral or skills needs of individual students as part of the
    20  regular education program. School building descriptions shall be
    21  submitted to the board of school directors which shall develop a
    22  coordinated district program description to be submitted to the
    23  department.
    24     (c)  The department shall pay each district submitting a
    25  description of its integrated, collaborative student support
    26  system an amount equal to the district's elementary weighted
    27  average daily membership multiplied by its market value/personal
    28  income aid ratio and the sum of $10.00. This amount shall
    29  initially be paid in the school year in which the description is
    30  submitted. In all subsequent school years the amount shall be

     1  included in the school district's "Equalized Subsidy for Basic
     2  Education" as defined in clause (18) of section 2501.
     3     Section 2.  Section 2501(18) of the act, amended July 1, 1985
     4  (P.L.103, No.31), is amended to read:
     5     Section 2501.  Definitions.--For the purposes of this article
     6  the following terms shall have the following meanings:

     8     (18)  "Equalized Subsidy for Basic Education." For the school
     9  year 1982-1983 and each school year thereafter, each school
    10  district shall be paid by the Commonwealth an equalized subsidy
    11  for basic education, which shall consist of any or all of the
    12  following, as applicable:
    13     (i)  Payments on account of instruction, as provided for in
    14  subsections (d) and (e) of section 2502.
    15     (ii)  An economic supplement, as provided for in section
    16  2502.11.
    17     (iii)  Assistance to small districts as provided for in
    18  section 2502.13.
    19     (iv)  Payment for an integrated collaborative student support
    20  system as provided in section 1512.1.

    22     Section 3.  The provisions of 22 Pa. Code Chapters 14 and 342
    23  insofar as they relate to or provide for instructional support
    24  services of any kind or type are rescinded.
    25     Section 4.  This act shall take effect immediately.
