AN ACT
1 Amending the act of June 23, 1970 (P.L.419, No.140), entitled
2 "An act establishing in the Department of Health a program
3 for the care of persons suffering from chronic renal
4 diseases, providing for an advisory committee in connection
5 therewith, designating powers and duties in relation thereto,
6 and making an appropriation therefor," requiring the Renal
7 Disease Advisory Committee to comply with the Sunset Act.
8 The General Assembly of the Commonwealth of Pennsylvania
9 hereby enacts as follows:
10 Section 1. Section 4 of the act of June 23, 1970 (P.L.419,
11 No.140), referred to as the Renal Disease Treatment Act, is
12 amended to read:
13 Section 4. (a) The Governor shall nominate and, by and with
14 the advice and consent of two-thirds of all the members of the
15 Senate, appoint a Renal Disease Advisory Committee, hereafter
16 referred to as the committee, to consult with the department in
17 the administration of this act. The committee shall be composed
18 of eleven persons representing hospitals and medical schools
19 which establish dialysis centers, voluntary agencies interested
20 in kidney diseases, local public health agencies, physicians
1 licensed to practice medicine in all of its branches, and the 2 general public. The members of the committee shall serve for a 3 two year period and may be reappointed. The committee shall 4 serve without compensation, but shall receive necessary travel 5 expenses. The chairman of the committee shall be elected by the 6 committee. The committee, with the approval of the secretary, 7 shall establish standards for the expenditure of State funds 8 which are provided for the support of persons suffering from 9 renal diseases to assure the availability of specialized 10 personnel, resources, and equipment necessary to enable such 11 persons to function and to care for patients with severe uremia. 12 The secretary shall choose from a list provided by the advisory 13 committee, the institutions which qualify under the standards 14 established to receive grants of State funds to provide care for 15 renal disease patients. 16 (b) The Renal Disease Advisory Committee shall be treated as 17 a statutory agency for purposes of the act of December 22, 1981 18 (P.L.508, No.142), known as the "Sunset Act."
