AN ACT 1 Authorizing the sale and conveyance of certain land owned by the 2 Township of Lower Paxton, Dauphin County, free from Project 3 500 restrictions. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Authorization. 7 The Township of Lower Paxton, Dauphin County, is hereby 8 authorized to sell and convey the lands described in section 2 9 free from any restrictions on use or alienation or other 10 encumbrances on title resulting from the provisions of the act 11 of January 19, 1968 (1967 P.L.996, No.443), known as The Land 12 and Water Conservation and Reclamation Act. 13 Section 2. Description. 14 The tracts of land authorized in section 1 to be sold and 15 conveyed free from any restrictions on use or alienation or 16 other encumbrances resulting from the provisions of The Land and 17 Water Conservation and Reclamation Act, are more particularly 18 described as follows:
1 All those certain tracts or parcels of land situate in the 2 Township of Lower Paxton, County of Dauphin and State of 3 Pennsylvania, being more particularly bounded and described as 4 follows, to wit: 5 Tract No. 1: 6 Beginning at a point on the eastern side of Nancy Drive, at 7 the division line between Lots Nos. 32 and 33 on the hereinafter 8 mentioned Plan of Lots; thence along said division line north 53 9 degrees 34 minutes east 125 feet to a point on the western line 10 of Tract No. 2 herein; thence along said last mentioned line 11 south 36 degrees 26 minutes east 162.75 feet to a point; thence 12 continuing along Tract No. 2 herein south 01 degree 02 minutes 13 west 275.41 feet to a point at line of land now or formerly of 14 George Megoulas; thence along said last mentioned line north 89 15 degrees 20 minutes west 147.54 feet to a point at the division 16 line between Lots Nos. 36 and 37 on the hereinafter mentioned 17 Plan of Lots; thence along said last mentioned line north 28 18 degrees 54 minutes 30 seconds west 143.95 feet to a point on the 19 southern line of Cheryl Drive; thence along said last mentioned 20 line and along the eastern line of Nancy Drive, by an arc having 21 a radius of 125 feet in a northerly direction, an arc distance 22 of 238.59 feet to a point, the place of beginning. 23 Being Lots Nos. 33, 34, 35 and 36 on the Plan of Laurel 24 Hills, Section B, which Plan is recorded in the Office of the 25 Recorder of Deeds in and for Dauphin County, Pennsylvania, in 26 Plan Book "W", Page 97. 27 Tract No. 2: 28 Beginning at a point at the intersection of the northeastern 29 corner of Lot No. 25 on the Plan of Laurel Hills, Section B, 30 which Plan is recorded in the Office of the Recorder of Deeds in 19900S1750B2447 - 2 -
1 and for Dauphin County, Pennsylvania, in Plan Book "W", Page 97, 2 at the line of land now or formerly of T. L. Haldeman; thence 3 along said line of last mentioned land north 89 degrees 31 4 minutes east 147.57 feet to a point on the western line of 5 Willow Road; thence along said last mentioned line south 36 6 degrees 04 minutes 30 seconds east 533.74 feet to a point; 7 thence south 07 degrees 07 minutes east 494.47 feet to a point 8 at the line of land now or formerly of George Megoulas; thence 9 along said last mentioned line north 89 degrees 20 minutes west 10 115 feet to a point on the eastern line of Tract No. 1 herein; 11 thence along said last mentioned line north 01 degree 02 minutes 12 east 275.41 feet to a point; thence continuing along the same 13 and along the eastern line of other lots of Section B of the 14 Plan of Laurel Hills aforesaid north 36 degrees 26 minutes west 15 730.58 feet to a point on the eastern line of Lot No. 25, 16 Section B of the Plan of Laurel Hills aforesaid; thence along 17 said last mentioned line north 20 degrees 09 minutes east 59.37 18 feet to a point, the place of beginning. 19 Containing: 3.2 acres. 20 Section 3. Restriction in deed. 21 If Tract No. 2, as described in section 2, is sold, the deed 22 conveying the land shall include a restriction to the effect 23 that the land shall be preserved in its natural state and not be 24 developed. 25 Section 4. Restriction of revenue. 26 The sum of $72,000, being the appraised value of the land 27 described in section 2, or the proceeds from the sale of the 28 land, whichever is greater, shall be deposited in a special 29 account established by the Township of Lower Paxton for 30 recreational purposes. 1 accrued thereon shall be used for the acquisition of park land, 2 recreational development or recreation and park planning, 3 subject to the approval of the Department of Community Affairs. 4 Section 5. Effective date. 5 This act shall take effect immediately. H2L85CHF/19900S1750B2447 - 4 -
