                                     AN ACT

     1  Amending the act of June 24, 1931 (P.L.1206, No.331), entitled
     2     "An act concerning townships of the first class; amending,
     3     revising, consolidating, and changing the law relating
     4     thereto," further providing for the selection of the township
     5     treasurer.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows: act of June 24, 1931 (P.L.1206,
     8  No.331),
     9     Section 1.  Sections 503 and 510 of the act of June 24, 1931
    10  (P.L.1206, No.331), known as The First Class Township Code,
    11  reenacted and amended May 27, 1949 (P.L.1955, No.569), are
    12  amended to read:
    13     Section 503.  Elected Officers Enumerated.--The electors of
    14  each township shall elect (a) at least five township
    15  commissioners, (b) subject to the provisions of section 510, one
    16  township treasurer, (c) except as hereinafter otherwise
    17  provided, one township assessor and one assistant township
    18  assessor, and (d) except as otherwise hereinafter provided,
    19  three elected auditors or one appointed auditor, or one

     1  controller where such office has been established. All elected
     2  township officers shall be registered electors of the township.
     3     Section 510.  Election or Appointment of Treasurer.--(a)  (1)
     4  The selection of a township treasurer may be by election as
     5  provided in subsection (b) or by appointment as provided in
     6  subsection (c).
     7     (2)  The determination of whether the township treasurer
     8  shall be elected or appointed shall be made by the township
     9  electors at a November election held at least two years prior to
    10  the expiration of the term of office of the current township
    11  treasurer. The court of common pleas shall, after the filing of
    12  a petition signed by at least ten per centum of the registered
    13  electors of the township filed at least one hundred twenty days
    14  prior to the election, direct the county board of elections to
    15  place a referendum question on the ballot of the township to
    16  determine whether the township treasurer shall be appointed. The
    17  results of the referendum question shall be returned to the
    18  court and presented to the township commissioners.
    19     (b)  At the municipal election in the year one thousand nine
    20  hundred and fifty-three, and subject to the provisions of
    21  subsection (c), every fourth year thereafter, the electors of
    22  each township shall elect a township treasurer for a term of
    23  four years, from the first Monday of January next following his
    24  election.
    25     (c)  If the electors of the township determine that the
    26  township treasurer shall be appointed, then at least thirty days
    27  prior to the expiration of the term of office of the current
    28  treasurer, the township commissioners by a majority vote shall
    29  appoint a township treasurer to serve a term of four years.
    30     (d)  When the township treasurer is unable to perform the

     1  duties of his office and fails or refuses to appoint a deputy,
     2  the court of common pleas, on petition of the township
     3  commissioners shall appoint a deputy treasurer to serve until
     4  the treasurer is again able to perform the duties of his office,
     5  or until such deputy is removed by the court, but in no instance
     6  shall such deputy serve beyond the term of the treasurer in
     7  whose office he is serving as deputy treasurer. The court shall
     8  also fix the compensation of such deputy treasurer at a rate not
     9  to exceed that paid to the elected township treasurer. For the
    10  time such deputy shall serve such compensation shall be deducted
    11  from the compensation otherwise payable to the township
    12  treasurer. Such deputy shall furnish bond in the same manner as
    13  the bond of the treasurer.
    14     Section 2.  This act shall take effect in 60 days.
