Subject: | Outdoor Advertising Control Act Legislation (Former House Bill 1273) |
I plan to introduce legislation amending the Municipalities Planning Code (Act of July 31, 1968, P.L. 805, No. 247). Specifically, the legislation I am proposing would prohibit the placement of outdoor advertising signs within 500 feet of an existing school, public playground, public park, residential housing area, child care facility, church or meetinghouse, or a designated state highway. An outdoor advertising sign is one that either uses computer or other mechanical technology to change the characters and illustration on the face of the sign, or is a static sign leased or rented. Typically, these signs are large and given their characteristics, pose a potential safety threat to motorists and pedestrians, and present a detrimental impact to the adjacent properties. I would also point out that this proposed legislation does permit a local government to permit these signs within 500 feet of the areas I have noted above. The municipality would be obligated to conduct at least one public hearing and ensure that all property owners within 500 feet of the proposed sign are notified at least 30 days prior to the hearing.
