Subject: | Amending Rule 14 regarding Members' and Employees' Expense for Legal Proceedings (Former HR 127) |
In the near future, I intend to introduce legislation which will amend Rule 14 providing for members' and employees' expenses. This legislation will limit when and to what extent tax dollars can be used to defend employees and members in the event of legal or civil proceedings. It limits reimbursement of legal fees to what is constitutionally correct under Section 15 of Article II of the Constitution of Pennsylvania. Additionally, it would provide a mechanism to allow the state to recoup any monies paid for legal fees covering activities that are later found to not be protected under Section 15 of Article II of the Constitution of Pennsylvania. Finally, it will allow for the Ethics Committee to issue a decision with regard to payment of these fees within 14 days of the request being made. The Ethic Committee's opinions shall be made public record;however, they may make deletions and changes as necessary to protect the identity of the persons involved.
