As the former Chair of the Task Force and Advisory Committee on the Consumer Credit Code, I previously introduced legislation based on the recommendations of the Advisory Committee, which were contained in two reports issued by the Joint State Government Commission in November 2006. In the near future, I am reintroducing HB 1393 of the 2011-2012 session. This legislation is the result of a consensus achieved by parties representing financial institutions, consumer advocates, automobile dealers, retailers involved in installment sales of consumer goods, as well as the Attorney General’s Office and the Department of Banking and Securities. The legislation amends Title 12 (Commerce and Trade) of the Pennsylvania Consolidated Statutes and creates Part V, concerning consumer credit. Specifically, the legislation codifies the provisions of the Motor Vehicle Sales Finance Act and the Goods and Services Installment Sales Act, makes conforming amendments to Title 42 and repeals the underlying 1947 and 1966 acts. Part V is a comprehensive statutory framework that modernizes and updates the existing law, taking into account substantial improvements in business practices, expanded federal regulations, advances in consumer protection law and changes in terminology.
