Subject: | Theft of Secondary Metal Legislation |
I am planning to introduce a bill which will add a new section to the Crimes Code (Title 18) which creates the offense of “theft of secondary metal”, defined as copper, aluminum or other metal, and wire, pipe or cable used by utilities and mass transit, which is valuable for recycling or reuse. Scrap metal theft is a serious, ongoing problem which affects every area of our state. It endangers the public and results in exorbitant repair and replacement costs which impact local and state government, businesses and individuals. I believe it is necessary to provide law enforcement with an effective tool to combat it. My proposal will establish penalties based on the value of the metal stolen:
The penalty for any second and subsequent offenses will also be graded as 3rd degree felonies, punishable by a fine of $2,500-$15,000 and/or up to 7 years imprisonment. Please join me in sponsoring this proposal. Thank you |
