In the near future, I will be reintroducing legislation that requires the state to recognize the wishes of a service member regarding the handling of his or her remains if that person dies during service. My proposal would recognize the procedure authorized by the service person on the DD Form 93. There have been instances where state courts have recognized someone who is designated in a will to make decisions about the handling of a service member’s remains. Unfortunately, some military service personnel have neglected to update their will when entering service, and there have been cases where ex-spouses have been designated to make these important decisions. My proposal will make it legally clear that these decisions should be determined according to the wishes of the person in military service as authorized on their DD Form 93. This proposal was SB 699 of the 2011-2012 legislative session and was co-sponsored by Senators MENSCH , RAFFERTY , ALLOWAY, D. WHITE , FERLO , ERICKSON , VOGEL, TOMLINSON , SCARNATI , SOLOBAY , GREENLEAF , FONTANA , HUGHES , M. WHITE , TARTAGLIONE , BREWSTER, STACK , EICHELBERGER , WAUGH and SCHWANK.
