Subject: | Water Testing Option for Property Owners Facing Application of Sewage Sludge on Neighboring Land |
I am reintroducing legislation that amends Act 97 of 1980, the Solid Waste Management Law. This was Senate Bill 1022 of the 2011-12 session of the General Assembly. Under this legislation, whenever a permit to apply sewage sludge to land has been granted, all adjacent property owners with a private water source who receive notice under section 271.913(g) in Chapter 25 (Environmental Protection) of the Pennsylvania Code shall be entitled to have their well water tested. This test shall be conducted, prior to the application of the sewage sludge, for baseline levels of nitrates, Escherichia coli, fecal coliform and total coliform levels. This testing shall be at the expense of the Department of Environmental Protection (DEP). Senators who co-sponsored Senate Bill 1022 were Costa, Farnese, Fontana, Kasunic, Rafferty, Solobay and Washington.
