Subject: | Requiring School Districts to Notify Municipalities of Plans to Acquire Property |
I am reintroducing legislation that amends Act 14 of 1949 (the Public School Code) to place notification requirements upon a school district when it plans to acquire property. Under this bill, the school district must notify a municipality when it plans to acquire property within that municipality. This was Senate Bill 1517 of the 2011-12 session of the General Assembly. This proposal was brought to my attention by a former township supervisor who found that since no advance notice is required before a school district acquires land or buildings, there can be no time for local officials to prepare for such a substantial impact. It is important to point out that this provision in no way impedes the current right of a school district to acquire property, but rather is designed to give a municipality some advance notice in order to prepare for any necessary infrastructure improvements, or to make changes to its comprehensive plan or zoning ordinance. Co-sponsors of Senate Bill 1517 were Senators Argall, Eichelberger, Erickson, Fontana, Pileggi and Rafferty.
