Subject: | Spousal Consent to Pennsylvania Municipal Retirement Benefits |
In the near future, I will introduce legislation which will require spousal consent when a retiring municipal employee chooses how his or her pension benefits should be paid. When a municipal employee applies to begin receiving pension benefits, he or she may select a single-life annuity which would not provide continuing payments to his or her spouse in the event that the retiree passes before the spouse. Current law does not require the employee’s spouse to be notified or to provide consent of this selection. Because no notification or consent is required, the spouse may not know that he or she will not receive any pension benefits after the retiree dies. My legislation will provide protection for spouses by making sure they agree to the chosen form of benefits. This legislation is part of phase two of the legislative agenda for the Women’s Health Caucus and is the municipal version of a bill already circulated by Senator Hughes with regard to state employees. |
