When our nation was founded, our forefathers crafted a Declaration of Independence and a Constitution both of which were intended to create a unique system of government grounded in liberty and free from the influence of foreign powers. As many young Americans throughout our history have fought and lost their lives to protect our sovereignty and freedom, I believe that it is vitally important to introduce legislation to protect the fundamental rights and liberties for which these young people have fought and died. In the near future, I intend to offer a proposal that will prohibit a Pennsylvania court from considering a foreign legal code or system which does not grant the parties affected by a ruling or decision the same fundamental liberties, rights and privileges granted under the United States Constitution. The fundamental liberties preserved under this bill include due process, freedom of religion, freedom of speech, freedom of the press and any right of privacy or marriage that is defined in the Pennsylvania Constitution. I should also note that, under my legislation, a foreign legal code or system would capture any legal code or system of a jurisdiction outside of the United States, including an international organization or tribunal. I hope you will join me in cosponsoring this important legislation, which is intended to ensure that no United States citizen or resident of the Commonwealth is denied the liberties, rights and privileges guaranteed by our constitutional republic because of the application of foreign legal doctrine. |
