Subject: | Monetary restitution for parents of convicted children |
In the near future, I plan to re-introduce legislation that would provide for the discharge of restitution liabilities maintained by parents of convicted children. Currently, state law provides that when a child is found guilty of an act that results in personal injury, theft or destruction of property and is sentenced to pay restitution for damages, a judgment can be made ordering the parent to assume a portion of the liability of the child’s restitution order. Payment of this liability oftentimes extends well beyond the time when a child is of a reasonable age to assume full responsibility for a restitution order. This legislation would set limits on parental liability by discharging all liabilities maintained by a parent once a child reaches 21 years of age. It would make the liability the full responsibility of the child. Please join me in co-sponsoring this legislation.
