Shortly, I plan to introduce legislation to improve efficiency and justice in the process of collecting and distributing restitution payments in a surprising but quite common situation. Often, a defendant is found guilty of an offense and is ordered to pay restitution and/or other costs, but that same defendant was a victim in a previous case and is owed restitution. Unfortunately, the lack of flexibility in current law requires counties to spend time and money to deliver restitution payments to that defendant and then turn around and try to collect restitution and/or costs - from the very same defendant to whom it just sent the check! My legislation offers a simple solution: When a county receives restitution owed to person A, but knows that person A owes costs and/or restitution to person B, the county can intercept and direct those funds to person B. Please join me in cosponsoring this common-sense legislation. |
