Subject: | Provisions on Criminal Background Checks for Employees |
In the near future, I plan to introduce legislation that will provide more comprehensive guidelines for employers when using criminal background checks to determine an applicant's qualifications. Employers will be required to consider certain factors in their determination an applications suitability for employment. They must also notify an applicant of any adverse actions taken as a result of that criminal history information. Employers who have considered the various factors in good faith, would then be protected from civil liability for negligent hiring or retention. |
