MEMORANDUM

Posted: June 15, 2016 12:35 PM
From: Senator John P. Sabatina, Jr.
To: All Senate members
Subject: Increase Fines for Texting while Driving

In the near future, I plan on introducing legislation that would increase the fines associated with texting while driving under Title 75 under subsection 3316. Prohibiting text-based communications.

Currently the State of Delaware is considering legislation that would also increase the fines to $100 for a first offense, and set the fine for each subsequent offense at $200-$300. My legislation would mirror this proposal. Currently, the fine for a first offense is $50. My legislation would double that fine for the first offense to $100, and $200 - $300 for subsequent offenses.

Many question if the nominal fine of $50 is of little deterrent to prohibit the dangerous act of distracted driving. The incremental increase of a violation of subsection 3316 could provide that deterrent

Please join me in support of this legislation.
