MEMORANDUM

Posted: February 1, 2017 11:05 AM
From: Representative Tina M. Davis
To: All House members
Subject: Transparency Prior to the Transfer of Municipal-Owned Infrastructure

In the near future, I plan to introduce legislation (former House Bill 1343 of the 2015-16 Legislative Session) that would offer greater transparency during the process of transferring municipal-owned infrastructure.

My legislation amends Title 53 (Municipalities Generally), creating a new chapter requiring municipalities to hold public hearings prior to the sale or acquisition of water and sewer infrastructure. My bill would also require municipalities to allow for public comment during a meeting concerning the sale of such infrastructure. Additionally, the language provides for ratepayers to be notified on their monthly billing statement prior to a public meeting regarding such a sale.

It’s important that our local governments (the form of government closet to the people) adhere to and respect open government and accountability. Please join me in co-sponsoring this legislation.
