Subject: | Authorizing DCNR enforcement officials to make arrests or cite outside of state park or forest lands |
In the near future, I plan to reintroduce legislation that would allow the Department of Conservation and Natural Resources (DCNR) to enforce Title 75 (Vehicles) provisions related to all-terrain vehicle (ATV) summary offense violations, even if the violation occurs outside of state park and state forest lands. Under current law, individuals appointed and commissioned by DCNR to preserve order in the state park or state forest lands are only permitted to enforce these provisions within the state park or state forest lands. These authorized individuals have the power to stop vehicles suspected of summary offenses, issue citations and, if a vehicle is stopped for a suspected summary offense, to make arrests where evidence appears of additional misdemeanor or felony offenses. Without the permission to pursue violators outside of the state park and forest lands, we prevent the enforcers of our laws from carrying out the important task of keeping the citizens of this Commonwealth safe.
