Subject: | Online Privacy and Security Bill Package – Allowing Customers to “Opt-Out” and Provide Consent Before Customer Proprietary Information Can Be Used |
In the near future, I plan to introduce legislation that would require an Internet Service Provider (ISP) or Telecommunications Company to allow a customer to “opt-out” of any collection or selling of their proprietary information. This bill will be a part of the Online Privacy and Security Bill package. As you know, Congress recently passed a bill that will reverse and block internet privacy rules that were passed by the Federal Communications Commission (FCC). These FCC rules were designed to protect consumers, however, this partisan reversal will now expose millions of Americans from having their personal information sold by ISPs and Telecommunication Companies to advertisers and other third parties. The General Assembly needs to take steps to protect Pennsylvanians from these invasive actions. Since Congress is allowing ISPs and Telecommunications Companies to collect and sell a consumer’s information, we need to allow Pennsylvanians the ability to say no and decline having their data and information sold to unknown companies and organizations. My bill accomplishes this by letting the consumer opt-out of these practices, but the companies would be prevented from retaliating or refusing service to that individual. Should a violation occur, my bill would consider that a violation of the Unfair Trade Practices and Consumer Protection Law.
