Subject: MDJ Contempt Powers
 
I am introducing legislation to allow Magistrate District Judges the power to impose summary punishments for criminal contempt. Retail theft incidents have greatly increased as a result of the opioid
epidemic. Defendants with prior retail thefts are avoiding fingerprinting orders to escape appropriate bail conditions.
My legislation amends contempt powers to include failure to obey a fingerprint order. MDJ’s will then have information necessary to address retail theft relating to drug addiction by imposing appropriate bail conditions, which will lead many defendants to recovery choices at earlier stages of the criminal process.
