Subject: | Unlawful Taking of a Tenants Rent Rebate |
Please join me in sponsoring legislation introduced as Senate Bill 497 in the 2015-2016 legislative session. The bill was co-sponsored by Senators Brewster, Tartaglione, Kitchen, Fontana, Farnese, Hughes, Boscola, Baker, Browne, and Haywood. The legislation will make it unlawful for a landlord and tenant to enter into any agreement that requires a tenant to pay or assign to the landlord any part of a rent rebate to which the tenant is entitled under the Taxpayer Relief Act of 2006. The Attorney General’s Office is granted the authority to enforce this act. Further, any landlord who violates the act will be required to fully reimburse the tenant any portion of payment along with penalties and interest on the total amount of the payment to which the tenant was entitled.
