Subject: Resolution Urging Congress and NCAA To Address NIL
 
In the near future, I will introduce a resolution urging U.S. Congress along with the National Collegiate Athletic Association (NCAA) to pursue legislative remedies that would help provide some uniformity of the Name Image Likeness (NIL) policy across states.
 
In June 2021, the U.S. Supreme Court unanimously ruled against the NCAA in NCAA v. Alston that the NCAA could not limit education-related payments to student-athletes. The NCAA then deferred to state laws on NIL and in states that hadn’t enacted laws, the schools themselves.
 
Most recently, on January 10, 2024, the NCAA Division 1 Council adopted new NIL protections which went into effect on August 1, 2024. These new protections are designed to protect student-athletes by promoting the sharing and centralization of information related to NIL deals such as contract terms and trustworthy service providers.
 
I believe there should be Congressional action to establish national guidelines for these NIL agreements and a more transparent environment. My resolution would express support for uniformity, fairness, oversight and most importantly, protection of our college student athletes.
