Over the past few sessions, we have seen a significant increase in the number of audit requests made by members of the General Assembly to the Auditor General. Due to the recent increase in legislative audit requests, the Auditor General and his department have expressed concern over their ability to perform all the audits requested by the legislature. In light of this concern, I plan to introduce legislation which would codify a process by which the General Assembly would formally request an audit be performed by the Auditor General. Under the bill, an individual legislator may request an audit by passing a resolution in either chamber or by writing a letter to the Legislative Audit Advisory Commission (LAAC). The commission would be required to meet no later than October 31st of each year to review legislative audit requests. After reviewing all legislative audit requests, LAAC is required to recommend by majority vote a list of these requests to the Auditor General. The recommendations, after being approved, must then be sent to the Auditor General’s office no later than December 31st. The legislation requires the Auditor General to conduct all recommended audits as long as the General Assembly has provided direct funds to complete them. However, if the audits recommended by LAAC exceed or are not accompanied by direct funding, the Auditor General may elect to not conduct the audit. This will ensure the Auditor General’s office is not forced to divert funds from its current responsibilities in order to comply with audits requested by the legislature.
