Subject: Resolution Requesting Guidance for the Use of Kratom
 
In the near future, I plan to introduce a resolution which would encourage the FDA to provide guidelines with respect to the over-the-counter supplement Kratom. Kratom has come under federal scrutiny recently with a proposal to reschedule the drug, but no action has been taken.

We have heard the stories about overdose deaths related to Kratom, yet others claim it is an effective alternative to opioids and other drugs.

The legality of Kratom has been called into question by both FDA and DEA actions. In late 2016, the DEA announced its intent to classify kratom as a Schedule I drug. After the announcement, almost 150,000 people signed a petition requesting the federal government reconsider their proposed action. After further investigation by the DEA, the federal government then withdrew its intent to schedule kratom. Since that time, the FDA and DEA have taken no further action.

Recently, legislation which would limit the availability and sale of Kratom in the Commonwealth was circulated. I have heard from many people who claim Kratom is helping them overcome addiction. Constituents have reached out asking me to prevent such legislation from becoming law. My review on kratom demonstrates this resolution is necessary for us to have information to address this issue.

We need guidance and regulations governing its use so those that do need it can have access without risking harm to others. This could save lives and help others in need.
