Please join me in cosponsoring legislation to provide for limited COVID-19-related liability to manufacturers, schools, businesses, non-profits, institutions of higher education, long-term care facilities and others who have opened up their businesses and are implementing reasonable care to follow CDC guidelines. The state-ordered shutdown has generated a series of changing mandates, guidelines and shifting recommendations for institutions, enterprises, and private businesses. No matter how someone perceives the scope of these restrictions, or their proper implementation, it is hard to imagine an environment more target rich for litigation. It makes sense to protect schools and businesses who have been trying to protect the public. This legislation would protect against litigation based on claims of ordinary negligence; gross negligence, intentional wrongdoing and willful misconduct would remain open for potential legal remedy. As we move Pennsylvania forward, we must protect the entities who have so bravely provided their best effort to our communities. |
