Subject: | Clarifying PennDOT's Responsibility for Drainage Facilities on State Highways |
In the near future, I plan to re-introduce legislation (HB 1775) clarifying responsibility for drainage facilities on state highways in boroughs and incorporated towns. For many years Pennsylvania boroughs have been financially burdened, with the responsibility for stormwater facilities on state highways in their communities. Borough officials are astonished to learn PennDOT is only responsible for the road and not the subsurface drainage facilities. Under the State Highway Law, the Secretary of PennDOT has the latitude to compel a borough to maintain the drainage facilities under a state highway. I believe this policy is shortsighted. If the Commonwealth is responsible for a state highway, it should be responsible for the total responsibility of the drainage structures as well. My legislation would clarify PennDOT's responsibility for drainage facilities connected to state highways in boroughs and incorporated towns. Please join me in cosponsorinq this legislation.
