Subject: | Municipal Tolling of Applications During a Disaster |
As we’ve learned, Pennsylvania law makes it difficult for municipalities to function during an emergency, such as the current COVID-19 pandemic. Because of this, we enacted temporary measures to aid how municipal governments operate during a declared disaster emergency. It’s time for us to make these temporary enactments permanent so that we are prepared for the future. For this reason, I am introducing a bill that pertains to tolling of applications before a municipal governing body, board, or commission. Under my legislation, the following will apply to any application, plan, or other submission for approval made during a declared disaster emergency: · The number of days for the political subdivision to act will be suspended and tolled from the date of the disaster declaration until 60 after the declaration has expired; · Political subdivisions must notify all affected applicants about the time extension and their right to request action with failure to receive notice not affect the tolling; · Applicants may request proceedings during the time window, but it will be at the political subdivision’s discretion to fulfill the request; and · Applicants and all other parties that receive notice of such proceedings waive any challenge to the proceedings.
