Subject: Amending the Unfair Trade Practices & Consumer Protection Law
 
Certainly, $100 does not carry the same weight it did 50 years ago.

And yet, currently, a person may only sue for actual damages or $100, whichever is greater, under our Unfair Trade Practices and Consumer Protection Law. 

Section 9.2 of this statute is outdated and needs to be amended to reflect today’s realities by allowing for the recovery of actual damages or $500, whichever is greater.

The current dollar amount has remained constant since enacted in 1968. This inadequacy was brought to my attention by Mary Bach, a long time consumer advocate in Allegheny County. 

There is no cost to the Commonwealth for this increase. Rather it will simply change the ceiling from $100 to $500. 

The increase is a matter of fairness for consumers who take lawful action and prevail in court. This legislation has passed out of the House Consumer Affairs Committee unanimously or near unanimously three times in recent years.
