Subject: | Lease land by recreational authorities for OHV riding (Former HB 1241) |
I am planning to re- introduce legislation that will encourage landowners to lease their land for use by recreational authorities for off-highway vehicle (OHV) riding. As the popularity of OHV riding in Pennsylvania has grown, more places to ride have been established throughout the state. In my district, the Northumberland County Anthracite Outdoor Adventure Area Authority has worked with public and private sponsors to provide riding opportunities on thousands of acres of former mine land. The ability of AOAA to grow, however, has be stalled due to liability concerns of neighboring landowners about leasing their property to the authority for public recreational use My legislation would amend the state’s current landowner liability protection law, the Recreational Use of Land and Water Act (RULA), to ensure that any consideration such as a lease payment provided to a landowner by a municipal authority such as AOAA, or the user fee to ride on that leased land, would not be considered a “charge” under RULA, which would bring those landowners under the liability protections of that law.
