| Subject: | E-Verify for All Public Contracts |
| In the near future, I will be introducing legislation to amend the Public Works Verification Act to require all public contractors and subcontractors use the federal E-Verify system. The federal E-Verify system is a convenient way for employers to ensure that their employees do not include individuals not authorized to work in the United States. In order to apply for a public contract, public contractors and subcontractors would be required to submit proof of registration in the federal E-Verify system, along with the verification form required by current law. In addition, this legislation would increase the penalties for contractors and subcontractors who fail to utilize the federal E-Verify system, including increased debarment periods from securing a public contract, and increased fines based on contract amount for those who fail to submit or lie on the verification form. The Department of General Services (DGS) would be charged with overseeing that public contractors and subcontractors comply with these requirements. DGS would also be required to acknowledge the complaints received and notify the complainant if enough information is not provided for an investigation. Finally, public contractors and subcontractors would reimburse DGS for the cost of an audit if they are found to be in violation of the law.
