Subject: | Reforming the Emergency Procurement Process |
In the near future, I plan to introduce legislation to reform the Commonwealth’s emergency procurement process. The emergency procurement process provides a faster and less formalized method for procurements when the circumstances create an urgency of need that cannot be met by the more formal competitive methods. However, reform is needed to ensure that the emergency procurement process is only used in exigent circumstances. Under this legislation, a request for an emergency procurement would have to be made by the head of the agency seeking to use the emergency process. The head of a purchasing agency (e.g. the Department of General Services) would also be required to provide additional written documentation of the need for the emergency procurement. Additionally, emergency procurements over $1 million would have to be approved by an Emergency Procurement Approval Committee, which would include appointees from the General Assembly and the Governor.
