Subject: Right-To-Know Law Disability Accommodations Exception
 
I plan to introduce legislation amending the Right-To-Know Law to create a new exception covering disability accommodations.

Recently, I was made aware of an issue pertaining to a mayor of one of my communities who happens to be deaf.  The mayor uses a device when in municipal executive session discussions that assists him by generating a visual transcript of the conversation.  However, there is a concern that even though it is generated in executive session (and arguably exempt from access by a requester under the Right-To-Know Law) it may nevertheless be subject to such a request as it is a written document of communication and therefore in the public realm.

My bill would amend Section 708 (Exceptions for public records) of the Right-To-Know Law to specifically provide that reference notes and working papers prepared by or for a public official or agency employee, which are used to accommodate an individual’s disability, shall be exempt from access by a requestor under the act.
