Subject: | Legislation Amending the Diesel-Powered Motor Vehicle Idling Act |
In the near future I will be introducing legislation amending the Diesel-Powered Motor Vehicle Idling Act. Currently under this law, an owner or operator of a location/business where diesel powered vehicles (such as tractor trailers), load or unload or provides 15 or more parking spaces these vehicles, shall erect and maintain a permanent sign to inform drivers that idling is restricted. However, even if an owner or operator is in compliance with the signage rule, they can still be fined by DEP for vehicles that are left idling by their driver. It is unrealistic for a busy business owner to constantly monitor the time that trucks spend on their property, and the onus should rather be on the vehicle driver to comply with the law and follow the required signage. Therefore, this bill will remove owners and operators of these locations from being able to be fined for diesel powered vehicles idling in violation of the Diesel-Powered Motor Vehicle Idling Act on their property.
