MEMORANDUM

Posted: December 21, 2022 10:45 AM
From: Representative Dawn W. Keefer
To: All House members
Subject: Off-Label Prescribing for Respiratory Syndrome Related Illnesses

I will be introducing legislation to allow for the prescribing and dispensing of off-label drugs approved by the United States Food and Drug Administration to treat severe acute respiratory syndrome, SARS, infections causing respiratory-syndrome-related illnesses without punitive action from the state.

Specifically, my legislation would allow prescribers to prescribe and pharmacists to dispense a therapeutic drug approved by the United States FDA so long as it is in accordance with a prescription drug order and with the patient’s informed consent. Additionally, my legislation will allow for use of such off-label therapeutic drugs at home or early-stage outpatient or hospital inpatient for individuals who wish to treat any SARS infection causing respiratory-syndrome-related illnesses.

Doctors take a Hippocratic Oath to do no harm and treat the sick to the best of their ability, and must be permitted to do so without capricious government intervention or fear of licensure sanction.

I hope you will join me in co-sponsoring this legislation.

Introduced as HB1123
