Subject: | Fiber optic broadband crossing railroad rights of way |
In recent years, we have focused in a bipartisan manner on ways to expand broadband access across the Commonwealth. One area of broadband infrastructure expansion that other states have already begun to address, and which my legislation addresses, is the thorny issue of fiber deployments that need to cross railroad rights of way. The goal of my legislation is to put a uniform process in place for both broadband service providers and railroad companies that removes unnecessary roadblocks, safeguards our taxpayers, and allows quick deployment of broadband infrastructure so that no Pennsylvanian is left without access. Specifically, my legislation establishes an application process for broadband providers when they find it necessary to cross railroad tracks; establishes timelines for approval of such applications; implements procedures for constructing or installing broadband across railroad tracks; establishes licensing fees; and provides for duties of the PUC.
