Subject: Helping Insurance Consumers Get More From Their Insurer
 
In the near future, we will introduce legislation to expand the ability of insurance consumers to receive value added services and products from their insurance company.
 
Under current law (Acts 22 and 23 of 2018), insurers and producers (insurance agents) are allowed to spend up to $100 (non-cash) when marketing insurance products to consumers. Current law also allows “the offering or giving to an insured, for free or at a discounted price, services or other offerings that relate to loss control of the risks covered under the policy.” 
 
Our proposal, which is based on model legislation from the National Association of Insurance Commissioners (NAIC), will permit an insurer or producer to offer consumers up to $125 in non-cash gifts, items, or services (including charitable donations) in connection with the marketing, sale, purchase, or retention of insurance.
 
Our bill also allows insurers and producers to offer consumers value-added products and services relating to insurance coverage. Such products and services must be offered in a nondiscriminatory matter and must be designed to provide loss mitigation, reduce claim settlement costs, enhance health, enhance financial wellness, or educate the consumer about liability risks.
 
Enactment of this legislation will potentially help consumers avoid losses, as well as better facilitate the marketing and purchase of insurance. It will bring Pennsylvania into the national mainstream by adopting an NAIC model.
