Recently, Governor Shapiro directed the executive agencies under his jurisdiction to examine all contract solicitations to determine if the use of a project labor agreement is appropriate and allowed. This directive has the potential to attach project labor agreements to a greater number of public road and building construction projects. Given the Governor’s action, I am preparing to re-introduce legislation to create the Project Labor Agreement Transparency Act. In the past, I have heard from several contractors, who have successfully been awarded contracts for public work projects – only to find out that there is a project labor agreement (PLA) they were not aware of attached to the project. PLAs typically increase the labor costs associated with a project, so it is problematic when bidders are not aware of this important information up front. My bill would simply require that a public body post notice of a PLA on its website at least 20 days prior to the solicitation of bids on a public project that the PLA will apply to. This will provide notice of the PLA to those who may want to bid on public projects for the public body. This legislation would not restrict the use of PLAs or regulate the contents of the agreement in any way. When a contractor is crafting a bid on a public project, it is only fair to make them aware of any PLAs that may factor into the cost of construction.
