MEMORANDUM

Subject: Towing During an Emergency as Instructed by Law Enforcement

From time to time, tow truck operators have found themselves facing a dilemma when the retrieval or rescue of a vehicle from the scene of an accident requires an illegal action, such as traveling in the wrong direction on a highway. Even when directed by a law enforcement officer, such actions put responsible tow truck operators in a very difficult position.

For this reason, I am introducing legislation that will exempt a tow truck operator from violations of state traffic laws and local ordinances while acting at the direct instruction of a law enforcement officer in the immediate response to an emergency. It is my hope that this legislation will alleviate the fear of legal repercussions that some tow truck operators may face when trying to respond to an emergency situation as efficiently as possible.

Predicting every potential scenario when creating laws is an impossible task. Too often, emergencies happen where responders have limited options available to them when quick action is necessary. I ask for your support of this legislation and to join me in this effort to provide tow truck operators leeway when performing a rescue or recovery operation at the direct instruction of a law enforcement officer.

Introduced as HB2233
