If the Department of Revenue discovers that they wrongfully issued a taxpayer a refund, they can demand payment from the individual. However, suppose a constituent filing state income taxes unknowingly overpays the Department of Revenue. In that case, the Department of Revenue is limited to the time they may look back when refunding overpaid taxes to just three years. These arbitrary limits can be devastating for those on a fixed income who cannot receive a full refund to help pay for food, housing, and other essential bills. Our proposed legislation offers a straightforward solution to this issue. It would give the Department of Revenue more flexibility in cases where a taxpayer petitions for a refund of an overpayment that is older than three years. Specifically, it would allow the department to review such overpayments and issue a refund on a case-by-case basis. This simple change has the potential to make a significant difference, enabling many more taxpayers to receive a fuller tax refund and providing them with much-needed financial support and relief.
