Subject: Hospital Regulation Misalignment JSGC study
 
Providing clarity and consistency to regulated industries is a nonpartisan issue and is always a priority for the General Assembly. While regulations are aimed at providing stakeholders with necessary guidance and best practices, confusion can arise when regulators provide conflicting or misaligned rules at the federal or state level.
 
I plan on introducing a resolution to direct the Joint State Government Commission (JSGC) to conduct a study and issue a report to the General Assembly on Pennsylvania hospital laws and regulations. The study will identify Pennsylvania laws and regulations that are not aligned with Federal law and the Centers for Medicare and Medicaid Services (CMS) regulations. The report will identify statutes or regulations that are in misalignment and will provide explanation recommendations to both the Department of Health and the General Assembly.
 
An example of this misalignment can be found in 28 PA. Code §135.5, a state regulation relating to surgical emergency care. This regulation does not align with Federal regulation CFR 482.51 on surgical services; therefore, creating unnecessary confusion for the regulated industry, which ultimately impacts our constituents.
 
As House Republicans, we will continue to be leaders in the efforts to "Get Government Out of the Way" and this resolution continues with these policy efforts.
