MEMORANDUM

Posted: December 2, 2022 04:17 PM
From: Senator Lisa M. Boscola
To: All Senate members
Subject: Establishing a Statement of Voter's Rights

I plan to reintroduce legislation amending the state Election Code by setting forth a concise Statement of Voter’s Rights. This bill would also require that the Statement of Voter’s Rights be visible in all voter registration offices and polling places. The statement includes:

(1) A voter who is in line at the correct polling place during the hours the polling place is required by law to be open, may vote, even if the voter's turn to vote does not come until after those hours expire.
(2) If a voter has moved from the voter's original polling district to another polling district, the voter may return to the original polling district to vote for as long as the voter remains qualified there. To be eligible to vote in the new polling district, the voter must either file a notice of removal with the voting registrar or register anew.
(3) A voter who has a need for assistance in voting by reason of blindness, disability, or inability to read or write, or is unable to read the names on the ballot or on the voting machine labels, may request such declaration upon their registration card prior to any registration deadlines, and select a qualified person to assist them in voting in the voting booth.
(4) A voter may take the voter's children who are not yet eighteen (18) years of age into the voting booth.
(5) A voter has the right to vote without being intimidated or forced to vote for someone the voter does not wish to vote for in an election.
(6) A voter who is registered to vote by mail, but who chooses to vote by machine, shall be entitled to vote by machine if the voter brings the voter's ballot received in the mail to the polling place on election day.
(7) A voter who believes that the voter's rights under this act have been violated may call the voter's local law enforcement officers.

I invite you to join me as a co-sponsor. Previous co-sponsors from SB 404 include, Senators: COSTA, FONTANA, CAPPELLETTI, and HAYWOOD.
