Subject: | Repealing an outdated provision from the Fireworks Law |
In the near future, I will introduce legislation to remove an unnecessary provision in the recently-amended Fireworks Law that went into effect in the Fall of 2022. Our law requires facilities that are licensed to sell consumer fireworks in Pennsylvania to comply with the 2006 version of the National Fire Protection Association (NFPA) standard for the retail sale of fireworks and pyrotechnics. However, due to a landmark decision by the NFPA Standards Council that made major changes, the most recent 2022 NFPA standard no longer applies to retail sales, storage, or use of consumer fireworks by the general public. As such, it makes sense to repeal the requirement from our law, which will also eliminate the need for our Department of Agriculture to enforce a standard that is no longer applicable.
