MEMORANDUM

Posted: June 13, 2023 12:44 PM
From: Senator Devlin J. Robinson
To: All Senate members
Subject: E-Verify for Asbestos Abatement Contractors

In the near future, I plan to introduce legislation to require asbestos abatement contractors, as part of their license application or renewal, to provide documentation of enrollment in the federal E-Verify program. The bill will also require asbestos abatement contractors to provide documentation of verification of the employment eligibility of all new hires that will perform asbestos abatement since their previous license renewal.

Asbestos abatement contractors are already required to utilize E-Verify for new hires under the Construction Industry Employee Verification Act of 2019. This legislation would simply require proof of enrollment in E-Verify as part of the annual licensing and renewal process under the Asbestos Occupations Accreditation and Certification Act of 1990. This will allow the Department of Labor and Industry to proactively deny licenses to asbestos abatement contractors that are not in compliance with current law.

Please join me in co-sponsoring this important legislation, which will prevent the exploitation of undocumented workers in the hazardous occupation of asbestos abatement.
