Subject: | Improving Consumer Convenience in Receiving Documents from Their Insurance Provider |
Shortly, I plan to introduce legislation based on model policy adopted by the National Conference of Insurance Legislators to benefit consumers. Under my proposal, consumers will be able to obtain documents from insurers in a more convenient manner by allowing employers to, by default, have their employees receive insurance documents electronically. This proposal results not only in consumers being able to receive their documents in a more efficient and timely manner, but the bill also reduces paper waste and lowers costs for participants in the plan. Importantly, any consumer who wishes to receive paper insurance documents may opt out of electronic delivery at any time of their choosing. Additionally, an insurer must provide a paper copy if they have reason to believe that a person can no longer receive their documents electronically (e.g., an email bounce), to ensure consumers receive insurance documents. Should the technology necessary to receive and read insurance documents electronically change, the company is required to notify each covered individual about the process to keep obtaining insurance documents electronically. This same notice must also provide a reminder to the consumer of their right to opt out of receiving insurance documents electronically.
